Adolescent Girls Should Control Their Sexual Urges: Calcutta High Court

Kolkata, Oct 21. The Calcutta High Court on Wednesday said that adolescent girls must control their sexual urges and adolescent boys should respect young girls.

The remark came while the court was acquitting a young man convicted of raping a minor girl with whom he was romantically involved.

According to BarandBench, the court was hearing a teenager’s appeal to overturn his conviction in a rape case. The young man was last year sentenced to 20 years in jail by a sessions court for having sex with his minor romantic partner.

The minor girl testified in court that she had sexual relations with the man of her own will and that she later married him. She went on to say that they were unaware that the age of consent for sex in India is 18 and that their relationship was as offence.

The bench, which included Justices Chitta Ranjan Dash and Partha Sarathi Sen, expressed concern about the POCSO Act conflating consensual acts among adolescents with sexual abuse, called for comprehensive rights based on sexual education, and ultimately made certain observations and suggestions for both boys and girls in reaching its decision.

The bench observed that sex among adolescents is normal but stimulation of such sexual urge is dependent on action by the individual, maybe a man or woman.

The court ordered the young girls to protect their right to bodily integrity, as well as their dignity and self-worth. It further stated that every young girl must control her sexual urges since “in the eyes of society, she is the [loser] when she gives in to the sexual pleasure of hardly two minutes.”

The court went on to say that guys should respect a girl’s dignity and train their minds to respect women.
